Patent Annual Maintenance Fees

After grant, maintaining your patent rights in Thailand requires timely payment of annual fees (annuities). These fees apply to invention patents, petty patents, and design patents, and are essential to keeping your rights in force.

While annuity fees begin accruing from the 5th year of filing, they are only due after grant. Any unpaid years must be settled in a lump sum. A 120-day grace period is available for late payments, subject to a 30% surcharge.

Lump-sum payment options available: 140,000 THB for Invention Patents (years 5-20), 2,000 THB for Petty Patents (years 5-6), and 7,500 THB for Design Patents (years 5-10).

How Patent Fees Are Structured in Thailand

Understanding the full cost structure of patent protection is essential for budgeting and compliance. In Thailand, official fees are typically divided into the following stages:

Filing Stage: Fees are due when the application is submitted to the Department of Intellectual Property (DIP).

Publication Stage: A fee is charged to publish the patent after a formality check.

Examination Stage: For invention patents, a fee is required when requesting substantive examination (within five years of publication).

Grant Stage: Once the patent is approved, a grant fee must be paid before issuance.

Maintenance Stage (Annuities): Annual fees become due from the 5th year after filing but are payable only after grant.

In addition to the core stages, applicants may encounter additional government fees depending on the circumstances of the case. These may include fees for opposition proceedings, appeals against refusals, and recordation of changes in ownership.

Translation Requirements

All patent documents — including the specification, claims, abstract, and any explanatory text in drawings — must be filed in Thai. Translation costs depend on source language and total word or character count

What are the recurring costs after a patent is granted?

The only recurring cost after a patent is granted is the annual maintenance fee (annuity) payable to the Department of Intellectual Property (DIP).
